Bondurant Mixson & Elmore LLP lawyers Frank Lowrey and Joshua Thorpe served as lead appellate counsel in an December 14, 2021 win before the Georgia Supreme Court. The Court ruled that property owners and parking companies have no right to boot vehicles parked on their property without authorization unless they are located in jurisdictions where a municipal ordinance expressly creates such a right. The property owners and parking companies had long contended that the common law creates such a right, allowing them to immobilize vehicles and demand payment for its release without any legislative authority. Following briefing and oral argument, the Georgia Supreme Court has unanimously rejected that position.
