Ga. Court Says Apt. Must Face Shooting Death Suit

The Georgia Court of Appeals upheld a decision that an apartment complex’s attempt to waive liability for third-party criminal acts in its lease agreement violates Georgia public policy and is void under statutory law. The premises-liability suit was filed by Shamecia Byrd's family following her death in a 2020 shooting at an apartment complex in Lawrenceville, Georgia.
Bondurant’s Naveen Ramachandrappa, representing the plaintiffs along with lead and co-counsel Mike Rafi and Alex Brown, commended the court's decision, noting it reaffirms longstanding tenant protections.
