Government and Internal Investigations

Bondurant’s government and internal investigations attorneys have extensive experience managing sensitive government investigations to minimize potential negative outcomes. We conduct timely internal reviews, interview key personnel, coordinate parallel proceedings, and, when necessary, negotiate resolutions with regulatory and enforcement agencies.

In recent years, Bondurant has been engaged by general counsels, corporate boards, and special litigation committees to conduct sensitive internal investigations involving the False Claims Act, Anti-Kickback Statute, Stark Act, government contract and grant fraud, antitrust laws, misappropriation of trade secrets, loan underwriting practices, options back-dating, bid-rigging, securities, bankruptcy, and tax fraud. We often use the results of internal investigations to persuade government lawyers not to pursue enforcement or to support a negotiated resolution, and we draw on those insights when defending follow-on actions by agencies or third parties.

Representative Work

Represented a publicly traded, nationwide supplier of durable medical equipment through numerous federal and state investigations of purported false Medicare and Medicaid claims, resulting in a civil settlement of False Claims Act allegations and no criminal prosecution of the company or its executives.

Navigated a federal and state investigation into E&M coding practices on behalf of a mid-sized medical practice, resulting in a modest repayment limited to the government’s investigative costs, with no administrative or criminal penalties imposed.

Defended a national debt-collection network during investigations by several state attorneys general and the U.S. Department of Justice’s Executive Office for U.S. Trustees, with no criminal or regulatory action brought against the client.

Represented the CFO of a publicly traded company in an options backdating investigation.

Conducted an internal investigation involving the CEO of a high-profile nonprofit corporation.

Investigated alleged construction contracting fraud against the Fulton County School Board, resulting in recoveries of several million dollars.
