Representative Work

Obtained a $281 million jury verdict, the largest compensatory damage award in Georgia history, against Turner Broadcasting System for breaching an agreement to sell David McDavid the Atlanta Hawks, the Atlanta Thrashers, and the operating rights to Philips Arena.

Won a $454 million jury verdict, the largest in Georgia history, for plaintiffs Six Flags Over Georgia in a breach of fiduciary duty action against Time Warner Entertainment.

Achieved a complete defendants’ jury verdict on accounting fraud, breach of fiduciary duty, and RICO claims arising out of a corporate merger, where the plaintiffs sought nearly $400 million in treble damages.

Achieved over $350 million in settlements and awards on behalf of business owners and high-net-worth individuals on professional liability claims arising out of tax shelters.

Won a $95 million jury verdict against Deutsche Bank, representing investment losses by Ponzi scheme victims.

Recovered settlements totaling $112 million on behalf of independent insulation contractors alleging price-fixing in the wholesale of residential fiberglass insulation.

Successfully represented an institutional investor in high-stakes fraud and RICO cases against Bank of America, Countrywide, JP Morgan, and UBS, involving the alleged fraudulent sale of over $6 billion in mortgage-backed securities and complex successor liability issues. After defeating the defendants’ attempts to remove and dismiss the complaint, we negotiated a series of significant confidential settlement agreements.

For more than twenty years, the firm has counseled and represented a major home improvement retailer in disputes with its suppliers, service providers, and insurance carriers. In addition to defending claims against the company, the firm regularly pursues affirmative recoveries to benefit the company.

Representative examples include litigating claims for insurance coverage, pursuing private claims and settlements against product suppliers accused of violating the antitrust laws, and advising the company on whether and when to opt out of class action settlements. The firm’s lawyers regularly argue appeals in the company’s most significant matters. Over the course of this relationship, the firm has litigated, arbitrated, and mediated all manner of disputes in courts across the country.
