Ga. Med Mal Win Nixed Since Atty Juror Not Struck For Cause

Danny Vincent successfully challenged a defense verdict in the Georgia Court of Appeals, which ruled it was reversible error not to strike a biased juror for cause.

The juror was an attorney at a local firm and regularly represented the defendant physician’s insurance company. The juror acknowledged a large risk of bias, but the trial court still refused to remove him for cause, forcing the plaintiff to use a peremptory strike.

The Court of Appeals unanimously reversed, holding that the plaintiff was denied her statutory right to a full panel of impartial jurors and remanded the case for a new trial. The ruling is significant because it clarified for the first time that the Supreme Court’s prior ruling in Willis v. State—a criminal case under a different jury statute—did not control the jury selection process in civil cases.

Missed Opportunity? Appellate Court Asked to Reconsider $12.1M Judgment Collection Efforts

The Georgia Court of Appeals recently ruled in favor of Sovereign Healthcare Holdings, preventing Mariner Healthcare from collecting a $12.1 million judgment.

Bondurant’s Chris Giovinazzo represented Sovereign Healthcare’s holding company and its executives, successfully defending against Mariner’s efforts to collect on assets transferred during Sovereign’s insolvency. Mariner, determined to hold Sovereign’s holding company and executives accountable for Sovereign’s debts, argued the transfer of assets in 2005 was fraudulent and the holding company was liable. However, the Court found the statute of limitations had passed for fraud claims, ruling that Mariner should have raised those claims earlier.

Samsung can’t void $10M judgment in exploding battery case

Georgia appeals court rules manufacturer is liable by default for injuries suffered by a Georgia man.

The Georgia Court of Appeals has reinstated a $10.8 million judgment against Samsung in favor of a Georgia man seriously injured by an exploding vape battery. Bondurant’s Mike Terry represented the plaintiff, who suffered permanent injuries in the 2019 incident.

After nearly five years of litigation and multiple appeals, the Court held that the case was properly filed in Chatham County and that Samsung’s attempt to open default came too late.

11th Circ. Gives Longshoreman Another Shot At Crash Suit

The Eleventh Circuit has revived a longshoreman’s injury case stemming from a crash at the Port of Savannah, ruling that questions about the driver’s employment status must go to a jury.

In a detailed opinion, the panel emphasized the need to consider the realities of daily labor assignments, where workers like the defendant may be considered “on the job” before clocking in.

Bondurant’s Naveen Ramachandrappa argued the appeal on behalf of the plaintiff.

Ga. Panel Considers New Statute In $46M Med Mal Case

In a closely watched appeal stemming from a $45.8M medical malpractice verdict, Bondurant’s Mike Terry argued before the Georgia Court of Appeals that the state’s new tort reform statute should not apply retroactively to reverse an attorney fee award made before the statute’s effective date and that doing so could disrupt hundreds of cases across Georgia tried before that effective date.

$140M verdict can’t stand, landlord argues after tenant’s fiery death

Bondurant partner Naveen Ramachandrappa, along with ​trial counsel Jeff Shiver and Darrell Hinson at Shiver Hamilton Campbell, continues representing the family of a 63-year-old tenant who died in a 2017 Atlanta apartment fire.

The landlord is asking the Georgia Court of Appeals to overturn the $140 million verdict, claiming the fire, set in retaliation, was not foreseeable.

In court recently, Naveen argued that the case is not about arson but the landlord’s failure to provide basic fire safety.
