Representative Matters

Appellate Litigation

  • Prevailed on appeal to the Georgia Supreme Court in a property tax dispute for a hospital authority, saving the authority millions in taxes.
  • Persuaded the U.S. Court of Appeals for the Eighth Circuit to affirm the remand of hundreds of cases from federal to state court in Combat Arms earplug litigation against 3M Company.
  • Argued and won a Georgia Court of Appeals case establishing the effectiveness of the plaintiff’s ante litem notice.
  • Assisted with an appeal against the Athens Housing Authority in a case establishing that housing authorities have no sovereign immunity from tort claims.

Business Disputes

  • Secured multi-million-dollar insurance coverage of breach of representations and warranties in a merger agreement for a publicly traded REIT.
  • Obtained confirmation of an eight-figure arbitration award on behalf of a former company executive and negotiated a favorable settlement.
  • Litigated and favorably settled an investment adviser’s claims against a former owner for violating restrictive covenants.Won a $2.6 million award in arbitration on behalf of an LLC minority member in a complex shareholder dispute.

Professional Liability Litigation

  • Recovered millions on behalf of a high net worth individual in an accounting malpractice claim against former income tax accountants.

RICO (Racketeer Influenced and Corrupt Organizations)

  • Defeated dismissal of RICO and securities fraud claims by convincing a federal court, in a matter of first impression, that a cryptocurrency qualified as a security.
  • Achieved dismissal with leave to amend of RICO and business tort claims against a coin-operated amusement business.

Pro Bono

  • Obtained injunction against the State of Georgia and the Georgia Attorney General prohibiting the execution of nine Georgia inmates.
  • Secured asylum for two Afghan refugees who fled after the U.S. withdrawal, allowing them to resettle permanently in Atlanta.
  • Volunteers regularly with the Atlanta Volunteer Lawyers Foundation in landlord-tenant and wage-and-hour disputes on behalf of low-income clients.
