‘Unbelievably Bad Conduct:’ Jury Returns Nearly $100 Million Verdict, Including Punitive Damages and Fees Against Trucking Company

A Fulton County jury has awarded nearly $100 million across two trial phases in a wrongful death case involving a fatal head-on collision and post-crash misconduct by the defendant, a trucking company.

The case centered on the defendant’s destruction and withholding of critical evidence, including dash cam data, driver logbooks, and the plaintiff’s vehicle’s airbag module, following a 2017 crash that claimed the life of a 46-year-old man. A judge’s 27-page spoliation order concluded the defendant had tampered with key evidence and played a central role in both phases of the trial.

The firm’s Michael Terry was part of the plaintiff’s trial team and will handle the anticipated appeal.

Ga. Appeals Court Backs Stroke Patient’s $75M Med Mal Win

Recently, the Georgia Court of Appeals upheld a $75 million verdict for a stroke patient who was left with locked-in syndrome after doctors at an Atlanta-area emergency room failed to diagnose his condition in time. The plaintiff was rushed to the ER after suffering a seizure, but due to a delay in diagnosis, he was left completely paralyzed, conscious only through his eyes.

Bondurant’s Michael Terry and Chris Giovinazzo were part of the legal team representing the plaintiff, along with attorneys from Bell Law Firm and Shamp Silk Trial Law Firm. Michael Terry presented oral argument in the Court of Appeals.

Fourteen Bondurant Mixson & Elmore attorneys recognized as 2025 Super Lawyers, two as Rising Stars

Bondurant Mixson & Elmore LLP (BME) proudly announces 14 of its attorneys are recognized as Super Lawyers and two as Rising Stars in the 2025 rankings. Notably, Mike Terry is named one of the top 10 attorneys in Georgia for the third consecutive year.

Each year, no more than five percent of lawyers in the state are selected by Super Lawyers, a Thomson Reuters rating service recognizing outstanding attorneys across more than 70 practice areas based on peer recognition and professional achievement. The selection process involves a statewide survey of lawyers, an independent research evaluation of candidates, and peer reviews.

The Rising Stars selection process is the same as Super Lawyers, with one exception: to be eligible, a candidate must be either 40 years old or younger or in practice for 10 years or less.

Ford Hit With $2.5B Punitive Verdict In Truck Roof Deaths Suit

A Columbus, Georgia, jury has rendered a $2.5 billion punitive damages verdict in the case of Brogdon (Mills) v. Ford Motor Company, following a $30.5 million compensatory damages verdict. The case involved tragic injuries sustained by Herman and Debra Mills in a 2015 Ford F-250 Super Duty truck rollover incident.

Partners Frank Lowrey and Michael Terry, along with lead counsel Jim Butler and other attorneys from Butler Prather LLP and Page, Scrantom, Sprouse, Tucker & Ford, P.C., represented the Mills family in this case.

$13.7M in ‘Reasonable Attorneys’ Fees’ Reentered After Challenge

Michael Terry, acting as appellate counsel, recently helped secure a $13.7 million attorneys fee award in a case linked to a record-setting $45.8 million medical malpractice verdict obtained by Stone Law Group in 2017. The award was initially vacated last January, but a Fulton County State Court judge reentered the eight-figure payout earlier this week.

Terry shared the brief writing and strategic planning along with attorneys from Stone Law Group, argued the fee motion in the trial court, and made the oral arguments on appeal.

Best Lawyers compiles its annual list of top attorneys by conducting thousands of peer review surveys. Only one lawyer is recognized as the “Lawyer of the Year” for each specialty focus and metropolitan area.

This marks the sixth “Lawyer of the Year” award for Lowrey, who was the top-ranked attorney in the Appellate Practice category last year and has made the Best Lawyers list every year since 2010. Chambers USA recognizes Bondurant Mixson & Elmore practice areas, attorneys in 2024 guide
